Terms of Service

 

Timeframes

The required project completion timeframe will be communicated before commencing the service.

General timeframes are as stated below.

 

Essentials Brand Package: 4-6 weeks

Premium Brand Package: 6-8 weeks

Website Design: 8-12 weeks

Packaging & Print: 2-4 weeks

 

These time frames will always be followed unless the client requires more than the 2 revisions included in each service. Clear and consistent communication means that the services usually can be completed sooner than the listed timeframes.

 

We understand if clients aren’t able to respond to emails quickly, although if a client takes more than 2 weeks to respond to an email they will be sent an invoice for the work completed and moved to the bottom of the waitlist. 

 

Revisions

Each service includes 2 revisions where the client is able to have input and ask for changes to the design. The client may purchase extra revisions if they would like more changes. The cost of these additional revisions will be negotiated upon request.

Approvals

While Claudia Jessica Design takes all care to avoid errors, Claudia Jessica Design accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production. The client is to proof read and approve all final copy before the production of artwork. No refunds or reprints are given after a final approved design has gone to print due to oversights by the client’s proofreading.

 

Payment

Before commencing the service, a 50% deposit will be required. The remaining 50% will be due before the final design files are sent or a website is made live. Invoices will be sent by email and are GST-inclusive. 

 

If the final invoice is not paid by the due date a late administration fee of $20 will be applied. Accounts which remain outstanding for 14 days after the date of invoice will incur an additional late payment fee equivalent to 5% of the project costs for each week payment is outstanding. If you are having difficulty paying your invoice, please get in touch as soon as you are aware of the issue, so we can discuss a solution that works for you.

Final Files
The final files for brand identity, packaging and print design will be sent via email in a zip folder or by Dropbox link. We will provide the necessary files for your project, although you may request specific file types at the beginning of the project.

 

Copyright/ Intellectual Property

All original designs and ideas are the property of Claudia Jessica Design. Logos and branding must not be changed or added to in any way unless a certificate of ownership has been received. 

 

Extra Costs

Fonts: all fonts are free unless a specific font is requested that the designer needs to purchase. In this case, the font files will be given to the client for future use. 

 

Printing: the client may arrange their own printing, but it can be done by the designer upon request. Any printing costs will be billed to the client. They will receive a quote for printing before any orders are placed.

 

Cancellation of Service

If the client wishes to cancel the service, they may do so at any time. In this case, the client will not receive their 50% deposit back. This covers design and administration time, resources purchased and allocated, and research time costs.

 

If the project is more than 50% completed (this is determined by Claudia Jessica Design and the client by negotiation) a pro-rata payment is payable for time spent up until cancellation notice, at the agreed hourly rate.

 

The provider may cancel the service at any time. The reasons that the provider may cancel the services are listed below. 

-Failure to respond to emails within 2 weeks

-The client refuses to give clear feedback or direction to the provider

-The client wants to go in a different direction than what was originally agreed upon and it doesn’t align with Claudia Jessica Design's skill set or company values.

-Abuse directed at the provider 

 

In any of these cases, the client will not receive their 50% deposit back.

 

If the provider cannot complete the service for any other reason that is not the fault of the client, the 50% deposit will be refunded. 

 

*Please note these terms and conditions do not apply to ongoing projects. A separate contract will be created in this circumstance.
